These Terms of Service govern your use of the MoirisArt online store at moirisartshop.com and your purchase of products from MoirisArt.

In these Terms, “MoirisArt,” “we,” “us,” and “our” mean MoirisArt. “You” means the person using the store or placing an order.

1. Use of the store

By using this store, you confirm that you are at least the age of majority in your place of residence or that you have permission from a parent or legal guardian.

You agree to provide accurate, current, and complete information and to keep your account and contact information updated. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

2. Products and made-to-order production

MoirisArt products may be made to order and fulfilled through Printify.

Product colors and appearance may vary slightly because of screens, materials, production methods, and product batches. Product descriptions, availability, prices, and images may change without notice. MoirisArt may limit quantities or discontinue products at any time.

Made-to-order products are produced specifically for an order before shipment. Production and delivery times depend on the product, fulfillment location, destination, and shipping method. Estimated delivery times are not guaranteed.

3. Orders and cancellations

Submitting an order is an offer to purchase. An order is accepted when MoirisArt or Shopify confirms it and payment is authorized or received.

MoirisArt may refuse, limit, or cancel an order because of product availability, pricing or listing errors, suspected fraud, shipping limitations, legal requirements, or other business reasons.

If MoirisArt cancels an accepted order, we will notify you and refund amounts paid for the cancelled portion.

You may request a cancellation or change before production begins, but we cannot guarantee that the request can be completed after production or shipment begins. Made-to-order orders generally cannot be cancelled after production starts.

4. Prices, payment, taxes, and customs

Prices, discounts, and promotions may change without notice. The price charged is the price shown at checkout when the order is placed, except where a clear error must be corrected.

Prices may not include shipping, taxes, customs, duties, or import charges unless checkout states otherwise.

You authorize the selected payment processor to charge the payment method provided and agree to provide accurate billing information.

International customers are responsible for applicable destination-country customs duties, import taxes, brokerage fees, and other charges unless checkout states that they are included.

5. Shipping and delivery

Shipping terms, free U.S. shipping on orders over $50, delivery estimates, tracking, address responsibility, international delivery, customs, delays, lost packages, and returned packages are described in the Shipping Policy.

MoirisArt is not responsible for carrier or customs delays or events outside our reasonable control, but we will reasonably assist with delivery investigations.

6. Returns, replacements, and refunds

Returns and exchanges are generally not available for made-to-order items when the customer changes their mind or selects the wrong size or color.

If an item is damaged, defective, or incorrect, contact MoirisArt within 30 days after delivery with the required photographs and order information.

7. Intellectual property

The MoirisArt store, including its text, artwork, designs, images, product names, logos, layout, and other content, is owned by MoirisArt or its licensors and is protected by applicable intellectual-property laws.

You may use the store for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, sell, scrape, or create derivative works from store content without written permission.

8. Reviews and customer content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the rights to submit it and that it is accurate and lawful.

You grant MoirisArt a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with operating and promoting the store.

MoirisArt may remove content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

9. Third-party services and links

The store uses Shopify and may use Printify, payment processors, shipping carriers, analytics providers, marketing applications, review tools, and other third-party services.

Third-party services may have their own terms and privacy policies. MoirisArt is not responsible for third-party websites, tools, content, or services except as required by law.

10. Privacy

Personal information is handled as described in the MoirisArt Privacy Policy.

Shopify hosts the store and checkout. Printify may process information needed to produce and deliver made-to-order products. Payment processors handle payment information.

By using the store, you acknowledge that information may be processed by service providers in other countries as described in the Privacy Policy.

11. Prohibited uses

You may not use the store to:

• Violate any law or another person’s rights.
• Submit false or misleading information.
• Interfere with store security or operation.
• Transmit malware.
• Harvest personal information.
• Scrape or crawl the store without permission.
• Send spam or phishing messages.
• Impersonate another person.
• Use the store for unauthorized resale, fraud, or abuse.

12. Errors and changes

The store may contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, or estimated delivery.

MoirisArt may correct errors, update information, or cancel affected orders, including after an order is submitted, subject to applicable law.

MoirisArt may update these Terms by posting a revised version. The updated Terms apply from the stated effective date. Continued use of the store after that date means you accept the revised Terms.

13. Disclaimer and limitation of liability

To the fullest extent permitted by law, the store and its content are provided on an “as available” basis.

MoirisArt does not guarantee that the store will always be uninterrupted, secure, timely, or error-free, or that products will meet every expectation.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the fullest extent permitted by law, MoirisArt is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by events outside our reasonable control.

14. Indemnification

To the fullest extent permitted by law, you agree to defend and indemnify MoirisArt and its service providers from claims, losses, liabilities, and reasonable costs arising from your breach of these Terms, misuse of the store, violation of law, or violation of another person’s rights.

15. Governing law and severability

These Terms are governed by the laws applicable in the jurisdiction where MoirisArt is headquartered, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

If any provision is found unlawful or unenforceable, the remaining provisions remain in effect.
